Terms of Service

Welcome to EZBounds! These Terms of Service ("Terms") govern your use of our application ("App") operated by EZBounds SOFTWARE LLC ("Company", "we", "us", or "our").

Please note: By using the App you grant us permission to use the projects you create to demonstrate and promote the App. We de-identify that content first, and you can opt out at any time. See Section 5 — Promotional and Marketing Use of User Content.

1. Acceptance of Terms

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use the App.

2. Accounts

You may create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Content

You may create and upload content through the App, including projects, legal land descriptions, metes-and-bounds text, plats, maps, drawings, scans, photographs, notes, and the CAD and geospatial files generated from them (collectively, "User Content").

You retain ownership of your User Content. By creating or uploading User Content, you grant us a non-exclusive, worldwide, royalty-free, sublicensable and transferable license to use, host, store, reproduce, modify, adapt, publish, publicly display, and distribute your User Content for the following purposes:

You represent and warrant that you own your User Content or otherwise have all rights, consents and permissions necessary to grant the license above, and that your User Content does not infringe the rights of any third party or violate any law, professional obligation, or duty of confidentiality you owe to a client or employer.

If you are subject to a confidentiality obligation that prevents you from granting the promotional license in Section 5, you should opt out of promotional use as described in that section before uploading the affected User Content.

4. Infringement Notices

If you believe that any content in the App infringes upon your intellectual property rights, please contact us at support@ezbounds.com.

5. Promotional and Marketing Use of User Content

We may use your User Content to demonstrate, promote, market and advertise the App. This may include:

5.1 De-identification

Before using your User Content publicly for promotional purposes, we will take reasonable steps to de-identify it by removing, blurring or replacing your name, your business name, your contact information, your client's name and contact information, street addresses, parcel identifiers, signatures, seals, license numbers, and other details that identify a specific person or a specific real-world property.

5.2 No attribution without consent

We will not publish your name, your business name, your logo, or a testimonial attributed to you unless you have given us separate written permission to do so.

5.3 Opting out

You may opt out of promotional use of your User Content at any time and for any reason. To opt out, email support@ezbounds.com from the email address associated with your account, or sign in to the App and reach us via Menu → Chat with us.

Opting out applies to future promotional use. Where your User Content already appears in published material, we will remove it from channels we control within a reasonable period after your request. We may be unable to recall material already distributed offline, printed, or re-shared by third parties.

Opting out does not affect your ability to use the App, does not affect the license granted in Section 3 for operating the App, and does not change the price or features available to you.

5.4 No compensation

You acknowledge that we are not obligated to use your User Content promotionally, and that you are not entitled to any compensation, royalty or fee if we do.

6. In-App Purchases and Subscriptions

The App offers in-app purchases, including subscription plans with a free trial option. Subscriptions will automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions through your account settings.

7. Intellectual Property

The App and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of EZBounds SOFTWARE LLC. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. Feedback

Any feedback, comments, or suggestions you may provide regarding the App is entirely voluntary, and we are free to use such feedback without any obligation to you.

9. Accuracy and Professional Responsibility

The App assists in parsing and rendering land descriptions, but its output is not a substitute for a professional boundary survey or for the independent judgment of a licensed surveyor. You are responsible for verifying the accuracy of any calculation, geometry, or exported file before relying on it. We do not warrant that parsed descriptions, computed closures, areas, or generated files are error-free or suitable for recording, legal, or construction use.

10. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, the licenses you granted in Section 3 end, except that de-identified User Content already incorporated into published promotional material may continue to be used, as described in Section 5.3.

11. Limitation of Liability

In no event shall EZBounds SOFTWARE LLC be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

12. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use and protect your information, including how we handle project content used for marketing.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
